1. Purpose and Scope

This Acceptable Use Policy ("AUP") establishes rules and guidelines for acceptable use of LocalBeat's platform and services. This policy protects LocalBeat, our users, and the broader internet community from harmful, abusive, or illegal activities.

2. Permitted Uses

3. Prohibited Content

3.1 Illegal Content

You may not publish, upload, or distribute content that:

  • Violates any law or regulation
  • Promotes or facilitates illegal activities
  • Contains child sexual abuse material (CSAM)
  • Depicts illegal drug manufacturing or distribution
  • Facilitates human trafficking or exploitation
  • Contains stolen or illegally obtained materials

3.2 Harmful or Dangerous Content

Prohibited content includes:

  • Content promoting violence, terrorism, or extremism
  • Instructions for making weapons, explosives, or harmful substances
  • Content encouraging self-harm or suicide
  • Graphic violence or "gore" content
  • Content promoting dangerous activities or challenges

3.3 Hateful or Discriminatory Content

You may not publish content that:

  • Promotes hate, violence, or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics
  • Contains slurs, epithets, or dehumanizing language targeting protected groups
  • Advocates for exclusion or segregation of protected groups
  • Denies well-documented historical atrocities

3.4 Adult and Sexual Content

The following are prohibited:

  • Pornographic or sexually explicit content
  • Content depicting minors in sexual or suggestive contexts
  • Non-consensual intimate imagery ("revenge porn")
  • Sexual solicitation or prostitution

Note: Educational content about sexual health, artistic nudity, and similar content may be permitted with appropriate context and age restrictions.

3.5 Harassing or Abusive Content

You may not create or publish content that:

  • Harasses, bullies, or intimidates individuals or groups
  • Contains personal attacks or targeted harassment
  • Publishes private information without consent (doxxing)
  • Encourages brigading or coordinated harassment
  • Creates fake or impersonation accounts to deceive or harm others

3.6 Misleading or Fraudulent Content

Prohibited content includes:

  • Deliberately false or misleading information (disinformation)
  • Scams, fraud, or deceptive schemes
  • Phishing attempts or credential theft
  • Pyramid schemes or multi-level marketing schemes
  • False impersonation of individuals, organizations, or brands
  • Fake news designed to manipulate or deceive

3.7 Infringing Content

You may not publish content that:

  • Infringes copyright, trademark, or other intellectual property rights
  • Contains pirated software, media, or materials
  • Circumvents digital rights management (DRM) systems
  • Violates confidentiality or non-disclosure agreements

4. Prohibited Activities

4.1 Unauthorized Access

You may not:

  • Access accounts, systems, or data without authorization
  • Attempt to bypass authentication or security measures
  • Share or use stolen credentials
  • Impersonate other users or administrators
  • Access restricted areas of the platform

4.2 System Interference

You may not engage in activities that:

  • Disrupt or interfere with service operation
  • Overload or stress-test our infrastructure without authorization
  • Introduce viruses, malware, or malicious code
  • Launch denial-of-service (DoS) or distributed denial-of-service (DDoS) attacks
  • Attempt to crash or degrade system performance

4.3 Data Scraping and Harvesting

Unauthorized automated data collection is prohibited, including:

  • Scraping content from Sites without permission
  • Harvesting email addresses or personal information
  • Using bots or automated tools to access the service at scale
  • Bypassing rate limits or access controls

Note: Legitimate search engine indexing and authorized API usage are permitted.

4.4 Service Abuse

You may not:

  • Create multiple accounts to circumvent limits or bans
  • Resell or redistribute service access without authorization
  • Use the service for cryptocurrency mining
  • Host file-sharing, torrenting, or piracy sites
  • Run proxies, VPNs, or anonymization services
  • Use the service primarily for media hosting or file storage

4.5 Manipulation and Deception

Prohibited activities include:

  • Manipulating analytics or engagement metrics
  • Using fake accounts or bots to inflate numbers
  • Engaging in "clickbait" or deceptive linking practices
  • Creating doorway or link farm sites for SEO manipulation
  • Cloaking content or using deceptive redirects

5. Technical Restrictions

5.1 Reverse Engineering

You may not:

  • Reverse engineer, decompile, or disassemble our software
  • Attempt to discover source code or algorithms
  • Modify or create derivative works without authorization
  • Remove or modify proprietary notices or labels

5.2 Security Testing

Unauthorized security testing is prohibited, including:

  • Vulnerability scanning or penetration testing without prior written consent
  • Attempting to exploit discovered vulnerabilities
  • Publicly disclosing security vulnerabilities without following responsible disclosure practices

5.3 API Abuse

6. Email and Communication Rules

6.3 List Hygiene

You are responsible for:

  • Maintaining accurate and up-to-date subscriber lists
  • Removing invalid or bouncing email addresses
  • Honoring unsubscribe requests promptly
  • Implementing double opt-in where appropriate
  • Retaining proof of consent

6.4 Content Standards

Email content must:

  • Comply with all content restrictions in Section 3
  • Not contain malicious links or attachments
  • Accurately represent your identity and purpose
  • Include required legal disclaimers

7. Intellectual Property Compliance

7.1 Copyright Respect

You must:

  • Only upload content you have rights to use
  • Respect copyright and fair use principles
  • Obtain proper licenses for third-party content
  • Provide attribution when required
  • Respond promptly to DMCA takedown notices

7.2 Trademark Use

You may not:

  • Use third-party trademarks in ways that cause confusion
  • Imply endorsement or affiliation without authorization
  • Register domains or accounts containing third-party trademarks
  • Use trademarks in meta tags or hidden text for SEO manipulation

7.3 AI-Generated Content

When using our AI Generation Studio:

  • Review AI-generated content before publishing
  • Ensure AI content complies with this AUP and applicable laws
  • Do not use AI to generate prohibited content
  • Comply with OpenAI's usage policies
  • Take responsibility for AI-generated outputs

7.4 DMCA Compliance

We comply with the Digital Millennium Copyright Act. If you receive a DMCA notice:

  • We will remove or disable access to allegedly infringing content
  • You may file a counter-notice if you believe removal was improper
  • Repeat infringers may have their accounts terminated

8. Monitoring and Enforcement

8.1 Right to Monitor

We reserve the right to monitor use of our services for compliance with this AUP, including:

  • Reviewing reported content and accounts
  • Analyzing usage patterns for abuse detection
  • Investigating complaints and violations
  • Monitoring system performance and security

8.2 No Obligation to Monitor

While we reserve the right to monitor, we are not obligated to actively review all content or activities. We are not responsible for user-generated content or activities conducted through our platform.

8.3 Automated Detection

We may use automated systems to detect:

  • Spam and abusive behavior
  • Security threats and malicious activity
  • Resource abuse and performance issues
  • Potential policy violations

8.4 User Reports

We rely on user reports to identify violations. Reported content and accounts will be reviewed by our team.

Upon receiving a report, we will:

  3. Take appropriate action if violation is confirmed
  4. Notify the reporter of outcome (when appropriate)

9.4 False Reports

Intentionally filing false or malicious reports may result in action against your account. Please report only genuine violations.

10. Consequences of Violations

10.1 Enforcement Actions

Depending on the severity and nature of violations, we may:

  • Warning: Email notification of violation with correction deadline
  • Content Removal: Remove specific violating content
  • Feature Restriction: Disable specific features (email, AI generation, etc.)
  • Temporary Suspension: Suspend account for defined period
  • Permanent Termination: Terminate account and delete all data
  • Legal Action: Pursue legal remedies for serious violations

10.2 Immediate Termination

We may immediately terminate accounts without prior notice for:

  • Illegal content or activities
  • Child sexual abuse material (CSAM)
  • Terrorism or violent extremism
  • Hacking or unauthorized access attempts
  • Distribution of malware
  • Severe or repeated violations

10.3 Appeal Process

If you believe enforcement action was taken in error, you may appeal by:

  1. Contacting appeals@mylocalbeat.com within 30 days
  2. Providing your account information and explanation
  3. Including any evidence supporting your appeal
  4. Awaiting review (typically 5-10 business days)

Appeal decisions are final. We are not obligated to restore accounts or content.

10.4 No Refunds for Violations

Accounts terminated for policy violations are not eligible for refunds of subscription fees or purchased credits.

11. Law Enforcement Cooperation

11.1 Legal Compliance

We cooperate with law enforcement and comply with valid legal process, including:

  • Subpoenas and court orders
  • Search warrants
  • National security requests
  • International mutual legal assistance requests

11.2 Reporting Illegal Activity

We may report suspected illegal activities to appropriate authorities, including:

  • Child sexual abuse material (CSAM) to NCMEC
  • Terrorism or violent threats to FBI/DHS
  • Financial fraud to FTC/SEC
  • Other serious crimes to relevant agencies

11.3 Data Preservation
